• The User Content does not contain malware or harmful code

This section does not apply to original artwork submitted for consideration under a separate artist, licensing, or collaboration process.

• YOUR USE OF OR INABILITY TO USE THE WEBSITE
• WEBSITE CONTENT
• THIRD-PARTY WEBSITES OR SERVICES
• UNAUTHORIZED ACCESS TO INFORMATION
• LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTISAN SWEET’S TOTAL LIABILITY FOR CLAIMS ARISING FROM THE WEBSITE WILL NOT EXCEED THE GREATER OF (1) THE AMOUNT YOU PAID DIRECTLY TO ARTISAN SWEET FOR THE SPECIFIC WEBSITE-RELATED SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE CLAIM; OR (2) ONE HUNDRED U.S. DOLLARS.

Nothing in these Terms excludes liability that cannot legally be excluded.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Artisan Sweet and its officers, directors, employees, contractors, artists, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

• Your unlawful use of the website
• User Content you submit
• Your infringement of another party’s rights
• Your fraud, misconduct, or negligence

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Subject to applicable consumer protection laws, any legal action arising from these Terms or the website must be brought in the state or federal courts located in the county in Georgia where Artisan Sweet maintains its principal place of business.

You consent to the personal jurisdiction and venue of those courts.

Before filing a legal action, you and Artisan Sweet agree to make a good-faith effort to resolve the dispute informally.
